Tense Moments Dominate Latest Impeachment Testimonies

Things got a little heated during the latest round of impeachment inquiry testimony when legal experts and scholars clashed with representatives during a tense session.

At one point, one of the scholars, Stanford Law Professor Pamela Karlan, slipped in a joke at the expense of President Trump’s son, Baron, setting off criticism from Rep. Gaetz.

While much of the testimony given centered on hypotheticals regarding Trump’s actions, the session has primarily set the tone for the next phase of the impeachment process.

White House Watch

House Drug Pricing Bill Will Hurt Americans

The White House released a statement this week, criticizing a House bill that would essentially force prescription drug manufacturers to reduce the production of life-saving drugs.

H.R. 3, which would give the Secretary of Health and Human Services the power to force drug companies to accept government pricing of prescription drugs, would force companies to slow down innovative drug development.

According to the Council of Economic Advisers, 100 fewer prescription drugs would enter the US market over the next decade, while drug companies would be able to sell those same products overseas.

Such a change could stifle the development of live-saving prescriptions and treatments in the US.

DeVos Wants To Overhaul Student Aid System

While many liberal politicians have attempted to buy votes by offering tax-payer funded buyouts of student loan debt, few conservatives have provided their own realistic solutions.

This week, Education Secretary Betsy DeVos unveiled a plan that will attempt to fix the broken system.

DeVos hopes to spin-off the Federal Student Aid division of the Department of Education as its own institution. Such a move would untangle the FSA, the largest consumer lender in the US, and reduce bureaucratic red-tape.

Of course, any changes would have to be approved by Congress. Given their track record, we aren’t holding out too much hope.

88-Year-Old Veteran Saves Child From Dog Attack With Nutcracker

You read that correctly. An 88-year-old US veteran from Ohio saved a 10-year-old girl from a pit bull attack by using a 3-foot-tall nutcracker from a Christmas display.

The older sister of the victim ran over to Leonard Miller’s home for help when the family’s pit bull latched on to the little girl and wouldn’t let go.

Miller, a Korean War vet, sprung into action and used part of a Christmas display to strike the dog until it released the girl.

INVESTOR INSIGHTS – Market Update 

Last week saw new records for the major market indexes.

The Dow Jones Industrial Average closed above 28,000.

And Monday futures are looking great for all three indexes.

But there’s one index showing that this bullish run could be in for a bearish correction.

And that’s the CBOE Volatility Index, or the VIX.

It’s used to measure the market’s “fear gauge.”

And right now, the VIX is indicating complacency.

On Friday, the VIX fell to 12.05. That’s right around half of what it was on October 2.

It’s the lowest it’s been since late July, and close to April ’19 and August ’18 lows.

It could indicate some modest stock market corrections.

It might not indicate anything at all.

But as history has shown, when the market becomes complacent, investors should be on the alert.

Worried about Google buying FitBit?

 

Then Project Nightingale will take it up a notch.

 

The project was first reported in The Wall Street Journal on Monday.

 

The DHHS’s Office for Civil Rights opened a federal inquiry into the project on Tuesday.

 

So, what is Project Nightingale?

 

It’s a new partnership for data collection between Google and Ascension, a leading nonprofit health system.

 

They are working together to analyze patient data to give health care providers “new insights and suggestions for patient care.”

 

The Office for Civil Rights “would like to learn more information about this mass collection of individuals’ medical records with respect to the implications for patient privacy under [HIPAA].”

 

It’s not the first time Google has faced public scrutiny for it’s handling of users’ private data.

 

Both companies have since made statements.

TRUMP DERANGEMENT SYNDROME

According to Michael Goodwin, we may not have a final tally on the Impeachment hearing’s winner.

But there is a clear loser.

And that’s the American people.

In trying to describe the “high crimes and misdemeanors” necessary for impeachment, there’s little consensus.

“Dems throw words at walls, hoping something will stick. Quid pro quo, bribery, extortion, abuse of power, obstruction and witness intimidation are all getting a tryout.”

He goes on to explain, “If impeachment were justified by facts, the right words would be obvious to the vast majority of Americans.”

What he has seen is the completion of the “strange evolution” of Nancy Pelosi.

After months of pushing back against the Impeachment push, she’s gone all-in.

“Pelosi is now the zealot leading the charge to boot Trump from office by any means necessary, facts be damned.”

Making the whole mess even more confusing.

It even got Barack Obama to enter the conversation.

While trying to calm donors down, he had a warning for progressives.

The country is “less revolutionary than it is interested in improvement.”

It’s left some on the left wondering which is scarier?

Warren or Sanders losing to Trump?

Or beating him and raising their taxes?

There is a clear winner in all of the fear and infighting, and that’s Trump.

INVESTOR INSIGHTS – Market Update 

While the Fed may be posting some bleak news, investors have other ideas.

When the markets closed on Friday, all three major indexes had posted all-time highs.

The S&P 500 secured a sixth straight week of weekly gains. That’s the longest streak in two years.

Here are the numbers as of the closing bell:

 

The S&P 500 was up 0.77% to 3,120.46.

 

The DJIA was up 0.8% to 28,004.89.

 

The Nasdaq was up 0.73% to 8,540.83.

The boost is credited to optimism that the US-China trade deal will soon reach a resolution.

Is Big Tech bad for Small Biz?

Not necessarily.

In a Hill hearing this Thursday, a few witnesses weighed in.

Their opinion?

Overall, tech giants have been a net positive for business and consumers.

One of those witnesses was Joe Kennedy of the Innovation Technology & Innovation Foundation. He thinks Big Tech is getting a bad rap.

“We should not enact new, restrictive laws or engage in new antitrust practices simply to rein in some of America’s most productive companies.”

Jake Ward was also there, from the Connected Commerce Council.

He said it was simple.

“Large data-intensive digital platforms such as Google, Amazon, Etsy, eBay, Yelp, and countless others benefit their businesses, help them compete, and accelerate their success.”

But a few of these Big Tech names are also sponsors for the CCC. Either way, Ward doesn’t want to see any big shake ups.

“Any change to this delicate ecosystem, let alone breaking up the largest companies, would result in fewer free or low-cost tools and services available. And it would be small businesses that pay the price.”

TRUMP DERANGEMENT SYNDROME

On Thursday, the Senate convened to consider a judicial nominee.

One bitterly opposed by liberals.

Bernie Sanders was at the Capitol. But he wasn’t there to cast a vote.

He was there to campaign.

When asked why he didn’t cast his ballot, he responded, “I am running for President.”

Then he was rushed off.

So here’s a question:

When is the last time Bernie voted in the Senate?

July. 4 months ago.

Actually, he’s missed about 56% of his opportunities to vote and do his job.

And he’s not alone.

All 5 Democratic senators eyeing the White House have missed over 100 votes.

Cory Booker is the biggest offender. He’s been absent 58% of the time.

Harris tied with Bernie at 56%.

Warren has been absent 44% of the time.

Klobuchar and Bennet have the best attendance record, but have still missed 30%.

The real shocker? No one seems to care!

Dick Durbin said this: “We don’t legislate. We’re dealing strictly with nominations, simple majority requirements. Their presence doesn’t make a difference.”

As minority members, Democrats seem to have given up. Even if they universally oppose a nominee, they still can’t win.

So, they don’t show up.

Looks like every day is Senior Skip Day for Senators eyeing the White House…

TRUMP IS WINNING

Day 2 of the Impeachment Inquiry was a lot like Day 1.

It’s hard not to reach a simple conclusion.

They don’t have a case. Just hype and lies.

And while that may have worked in their favor with behind-closed-doors hearings, it doesn’t work for public hearings.

Case in point?

Their “star” witness, former Ambassador Marie Yovanovitch.

It took just two questions from Republican House Intelligence Committee member Chris Stewart to cut through the crap.

Question 1: “I would now feel compelled to ask you, Madam Ambassador, as you sit here before us, very simply and directly, do you have any information regarding the president of the United States accepting any bribes?

Answer: “No.”

Question 2: “Do you have any information regarding any criminal activity that the president of the United States has been involved with at all?”

Answer: “No.”

His conclusion?

“The American people are going to be able to see the evidence and they’re going to be able to make their own determination regarding that.”

Mark Meadows’ conclusion?

“They have no case. This is not serious.”

CRAZY-INTERESTING OR RIDICULOUSLY-WEIRD

In 2017, video of a UFO encounter witnessed by the Navy got leaked.

And it’s taken the Internet by storm.

The actual event happened in 2004. The fact that it saw the light of day is pretty amazing.

Because 20 minutes after the event, modern-day “Men in Black” came to squash the whole thing.

The men who were there had to turn over all of their recordings.

Then, all recordings on the ship were deleted.

“They even told me to erase everything that’s in the shop — even the blank tapes,” he told Popular Mechanics.

INVESTOR INSIGHTS – Market Update 

Friday looks like a good day for the markets.

Investors are looking forward to the release of retail sales data.

And it looks like they’re expecting good news.

Dow Futures were up 81 points (0.3%), at 27,827.

S&P 500 futures are up 8.1 (0.29%) at 3,105.

Nasdaq-100 futures are up 31 points (0.4%) to 8,296.75.

This is after modest losses yesterday for the Dow and Nasdaq.

Meanwhile, the S&P 500 pushed further into unchartered territory with a 0.1% rise to 3,096.63.

Developments with the US-China trade deal have stalled for now.

 

But the outlook is still optimistic.

 

But the big headline investors are waiting for are in the October retail sales figures.

 

They are expecting a 0.2% rise after a 0.3% fall in September.

Is China giving Silicon Valley a run for their money?

Once viewed as an “imitator”, China is now aiming to be a global leader in tech areas from blockchain to AI.

And the US-China trade war isn’t slowing them down.

Topics like the future of AI, blockchain, smartphones and financial tech will be the highlights of the upcoming East Tech West conference.

In 2017 Beijing put plans in place to become the world leader in AI by 2030.

 

The goal?

 

To have their industry worth 1 trillion yuan, or $1447.7 billion.

 

“The US still has the lead on R&D in AI, but China is catching up with the tech titans in AI as well as numerous well-funded startups such as Face++, Sensetime and iFlytek.”

 

They’re focusing on financial technology, too.

 

Globally, fintech ventures more than doubled in 2018. China accounted for roughly 46% of that figure.

TRUMP DERANGEMENT SYNDROME

“It was a tepid bore.”

Those were the words of Fox News legal analyst Gregg Jarrett.

And he was talking about the much anticipated Day 1 of public impeachment hearings.

And more panelists and journalists are wondering if Democrats have botched the whole thing.

So far, only two Democrats have voted against formalizing the impeachment inquiry.

After another week or more of this, others could join them.

The drama.

“I’m starting to think that Democrats maybe made a mistake in doing the private hearings first and then releasing the transcripts, because a lot of people’s reaction to the public testimony… is ‘We knew this already.'”

Is Impeachment-palooza loosing steam?

Jarret thinks so.

“I think people are sick of it right now, especially since it is so close to an election. I think they’re saying to themselves, ‘My God, are you really going to try to remove the president? Just, you know, months before we have a right to judge whether he should be removed?”

THE TECH STOCK DUMP

It appears that some of America’s richest investors are dumping shares of tech stocks at an alarming rate.

Berkshire Hathaway, for instance, dumped 2.9 million shares of Apple earlier this year.

Appaloosa Management sold more than half of its stake in Facebook.

And Amazon founder Jeff Bezos recently sold off nearly $3 billion worth of his own company’s stock.

What exactly is going on?

It turns out that instead of pouring money into high-flying tech stocks…

Investment dollars are flooding into a different corner of the financial markets.

And it’s only just beginning.
 

TRUMP IS WINNING

The highlight of yesterday’s Impeachment proceedings weren’t what was said.

It was what was left unsaid.

And Fox News contributor Ari Fleischer didn’t miss it.

In a Tweet, he captured it perfectly.

“Rep. Ratcliffe just asked the most important question of the day: Was there anything in President Trump’s July 25th phone call that was impeachable. Neither witness said yes.”

Instead, they told the panel it wasn’t for them to decide.

Taylor’s response, “I’m not here to take one side or the other, that’s your decision.”

CRAZY-INTERESTING OR RIDICULOUSLY-WEIRD

There’s been some weird news out of Mars.

The Curiosity Rover has found some oxygen anomalies above Mars’ Gale Crater.

Oxygen levels fluctuate – a lot – as the seasons change.

And this strange cycling can’t be explained by chemistry as we know it.

Oxygen is rising as much as 30% during spring and summer, then dropping lower in the winter.

 

 

 

No one really knows, and the Rover isn’t set up to test for it.
